1. Who we are
Gemmi ("we", "us") operates www.gemmi.jewelry, a marketplace connecting independent jewelry sellers with buyers worldwide. Gemmi is the merchant of record for payment collection and holds funds in escrow; the sales contract for each piece is between the buyer and the listed seller.
2. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. We may suspend accounts involved in fraud, counterfeits, off-platform dealing, or abuse.
3. Purchases, escrow and inspection
Payments are processed by Stripe and held by Gemmi until the buyer's 7-day inspection period ends. Refunds during the inspection period follow our Buyer Protection policy. After release, payment disputes are handled between the parties with Gemmi mediating in good faith.
4. Seller obligations
Sellers must list only items they own and may lawfully sell, describe them accurately, provide genuine certificates, ship with insured tracked delivery within 5 business days of payment, and comply with export/import law of the relevant countries, including the Kimberley Process for rough diamonds. Counterfeit or misrepresented items result in permanent removal and forfeiture of pending payouts to cover buyer refunds.
5. Fees
Gemmi charges sellers a commission on each completed sale, disclosed in the merchant dashboard before listing. Commission rates may change with 30 days' notice and never apply retroactively to completed orders.
6. Prohibited conduct
No counterfeits or replicas sold as genuine; no undisclosed treatments or lab-grown stones sold as natural; no circumventing the platform to transact off-platform after connecting through Gemmi; no unlawful, deceptive, or infringing content.
7. Liability
To the extent permitted by law, Gemmi's aggregate liability for any claim is limited to the fees we earned on the order concerned. We do not exclude liability where it cannot lawfully be excluded.
8. Changes and contact
